Topic: Overview of the Course and the History of the Legal Profession.
TASK:
Answer
the following questions supporting your responses with statutory authorities
where applicable.
1. Gbade
is representing Ajada in a legal matter. Gbade is very passionate about his
client’s matter that he breaks down in tears in the course of arguing the matter
in open court. To whom does Gbade owe the first duty?
2. Ade
was recently called to the Nigerian Bar last month. He intends to set up a law
chambers and has called on Shirley who is awaiting her Bar results at the just
concluded Bar final exams. Can they practice together?
3. Okon,
a legal practitioner with the law firm of Tamuno, Okon and Ahmed has just been
elevated to the Bench. Tamuno and Ahmed are ready to change the name of the
Firm to Premier Law firm while Okon wants the name to remain as it is. Comment
on the propriety of this.
4. Venus
has been briefed by her client Vanessa, that she is interested in disposing the
property her late mother left her on her demise. The property is somewhere in
the Ajah axis of Lagos. Venus has just put up an advert on the OLX site looking
for a property to purchase for her personal use. Can she buy Vanessa’s
property?
5. Odigie
bought 50 pieces of Mac computers from Adebayo at the sum of N350,000.00 per
piece. Odigie who recently lost his father-in-law has been caught up in a lot
of funeral expenses and as a result not been able to meet his financial
obligations towards Adebayo. Adebayo who is also in desperate need of his money
has promised to Sue Odigie. He has approached you to file the necessary papers.
What should be your first reaction as a lawyer bound by the rules?
6. Priscilla
has marital issues with her husband, Clinton. As a result, both parties barely
see eye to eye which has driven Priscilla into an affair with her boss in the
office. She has confided in her lawyer, this piece of information. Her lawyer
who is an astute worker in the house of the Lord feels that Priscilla is a
sinner and must be reported to her husband, can she report?
7. Lawyers
that Nigeria produced before 1962 were classified as half-baked. Give reasons for this description.
8. Mention
5 recommendations that were put forward by the Committee that saw to the
establishment of legal education and admission to practice in Nigeria post 1062.
9. How
many categories of persons does the legal profession recognise as being able to
practice Law today in Nigeria?
10. As
students of the Law School, what conditions must you fulfil to be called to the
Nigerian Bar before the end of next year?
